Abstract EN

The exception of unconstitutionality mechanism is considered a basic means to trigger the constitutional case and one of the moste important defensive mechanisms established to protect the rights and freedoms of individuals.

Therefore, various constitutions of the Maghreb countries, including Algeria and Morocco, organized their provisions and the modalities of their application and the ways in which one of the parties to the case resorted to the constitutional bodies in their recent amendments.

Therefore we aim, through this study, to shed light on the concept of the exception mechanism and the procedures followed in Algeria and Morocco where we conclude that they are largely identical, especially since the goal is the same with slight differences in the wording and terminology used and in naming constitutional institutions.
