Abstract EN

This article aims to clarify the legality of wife’s dowry, as her pure right, but sometimes it may not apply.

It also aims to clarify the Sharia provisions, and jurisprudential opinions in musqitaat almahr (reasons for dowry non-applications) in order to eliminate the marital disputes arising from conflict due to whether wife deserves whole dowry or some of it.

The study pinpoints the cases where whole dowry is inapplicable such as when the woman killed herself before wedding night.

It also shows the cases where the wife deserves only half of the dowry such as when the wife is divorced before wedding night, and after mentioning it in the espousal (i.e.

marriage contract).

There are also other cases of musqitaat almahr discussed in the study.
