The subject of the study aims to research the disputes that arise regarding the provisional results of the legislative elections under order 01 / 21, and to review the provisions of the texts in force, compared to the canceled texts, and it was concluded that the role of the constitutional court under order 21-01 is not different from the role of the former constitutional council, as it exercises the same powers that was entrusted to it considering the appeals submitted before it with the aim of examining the legitimacy of the results of the legislative elections, to decide, by the way, to cancel or reformulate them, as the case may be, but its jurisdiction is encountered by several difficulties that require the intervention of the legislator on the one hand, and the exercise of the constitutional court’s role within the scope of the need to expedite the issuance of the internal system related to its rules of work.
