The constitutional court is an independent institution charged with ensuring respect for the constitution, it controls the functioning of institutions and the activity of public authorities within the framework of the oversight function, the Algerian legislator determined its composition and granted the president of the republic granted the power to appoint four (4) members, including the president of constitutional court, the constitution also granted him the power to determined the conditions and modalities for electing six (6) members of constitutional law professors.

in terms of the functionally the constitutional court exercises its oversight function based on a notification from constitutionally authorized bodies, and the president of the republic is considered among the bodies that have the power to notify the constitutional court to exercise its constitutional functions.

among the new powers of the constitutional court is the power to consider disputes that may occur between the constitutional authorities, as well as the interpretation of one or several constitutional provisions based on notification the president of the republic.
