المستهلك هو الطرف الأضعف في العقود الإلكترونية، و خاصة العقود التجارية الأضعف في العقود الإلكترونية، و خاصة العقود التجارية (بائع نحو مستهلك).
توجد أنظمة قانونية مختلفة لحماية المستهلكين مثل القانون رقم 09-03 المتعلق بحماية المستهلك و قمع الاحتيال و القانون رقم 04-02 المتعلق بالقانون الذي يحدد القانون القواعد المطبقة على الممارسات التجارية و القانون و قانون التجارة الإلكترونية رقم 18-05 وجاءت جميع هذه النصوص الخاصة بعد فشل النصوص القانونية العامة مثل القانون المدني في توفير الحماية الفعالة مع التطور التكنولوجي الضخم الذي يعرفه عالم التجارة من سرعة و الائتمان في دخول السلع و الخدمات أدى ظهور منتجات معيبة و مغشوشة و الخدمات التي تضر بصحة وأمن المستهلك إلى قيام المشرع الجزائري بإعادة التفكير في حماية المستهلك في التعاقد الإلكتروني، و الذي يتم في مكان وزمان مختلفين و استخدام الوسائط الإلكترونية مثل تجار محتلون يبيعون سلعهم و خدمتهم عبر الإنترنت بهدف الحصول على ربح أكبر ربح ضعف عرض جدار الأمن و الصحة و السلامة ج عرض الحائط خاصة إذا كان العقد يتم عن طريق عقد إلكتروني يلفه مستهلك ضعيف و افتراض تدخلي افتراضي قوي، لذلك سوف نلقي الضوء في هذه الورقة على ضمانات الحماية في مرحلة تشكيل العقد الإلكتروني و مرحلة تنفيذ العقد الإلكتروني للمستهلك عبر تشريعات الجزائر وغيرها من القوانين الدولية المتعلقة بحماية المستهلك.

There are various legal systems in place to protect consumers such as law number 09-03 relating protection of consumer and repression of frauds and law number 04-02 relating The law defining the rules applicable to business practices and law and Electronic Commerce Law No.
18-05All these special texts came after the failure of the general legal texts such as civil law to provide effective protection With the huge technological development known by the world of speed and consistency in the entry of goods and services the emergence of defective and adulterated products and service that harm the health and security of the consumer led the Algerian legislature to rethink consumer protection in electronic contracting, which is done in a different place and time and using electronic media such as the Internet Fraudsters intend to get the biggest profit twice the security wall display, health and safety consumer wall display Especially if the contract is done by electronic contract enveloped by a weak consumer and a strong virtual interventionist hypothetical so we will highlight in this paper on the safeguards of protection in the stage of the formation of the electronic contract and the implementation phase of the electronic contract for the consumer throughout Algiers legislation and others international laws concerning protection of consumer
