Abstract EN

The procedural acte is the legal work which has influence regardless the officer-in-charge desire and will as long as it gathers the requirements necessary for its formation and existence, and is consistent with its form as stated by the procedural legislator in imposing the legal rule and arranges a penalty for violating this.

In order to preserve the legal system and the interests of the opposing parties to the conflict, the legislator required that this procedural acte meet certain requirements and assumptions that guarantee the existence and validity of this acte.

Hence, the study problem is that these requirements even if they are objective or formal require to identify and know their contents, the consequences of their non-availability and the implications of this on the validity of the components of the litigation and knowledge of the defenses that arise from them or otherwise.

This matter contains accuracy and problems that may confuse the specialists themselves.

Accordingly, this study was divided into five chapters to define the procedural acte and its characteristics and to determine the necessary requirements for its existence and the legal effects and legal penalties resulting from its failure.
