The paper presents a fiqhi study of the case mentioned in the Prophet’s words “If a creditor finds his very property with a debtor who becomes bankrupt”.

This includes what the jurists stated about this case, relating to the right of the creditor to reclaim his property that he found with the debtor, but with conditions.

This will be compared to the relevant argument in the Saudi bankruptcy system and bylaws.
