This brief research, labeled "Illegal Migration and its Provisions in Islamic Jurisprudence", identified illegal migration, explained its causes and motives, then addressed its jurisprudence and the means to combat it, and concluded the research with the most important conclusions and recommendations.
The research concluded that the origin of migration is a delegate in Islamic Sharia, a right guaranteed in the Constitution and the law if its purpose is to pursue immediate or future interests, and it is in accordance with the laws enacted by each State for entry, exit and residence, but if it is carried out in a manner not permitted by the laws of the country of immigration or emigration or both, it is illegal immigration, which is not permissible; "for breaking with the ruler, and for involving too many infringements and risks, such as self-destruction and self-humiliation, in some of its forms, of falsifying, cheating and deceiving the authorities of the two countries of origin and immigrant, which is a lie, and a threat to national security.
" Those who migrate illegally through the sea by unsuitable means are guilty.
If they die by drowning, they bear witness to a statement from the people of science.
If they cause the infection to other healthy people without their intention, and the transferee dies, there is no retribution for them; He did not intend to kill.
Rather, he must atone for himself, his parents, and his mentality must bear responsibility for him.
Illegal migration can be combated by several measures, the most important of which are: tightening border controls by building security barriers, monitoring them more strictly, and focusing on international cooperation projects between rich and poor countries to support development projects that help reduce unemployment and increase poverty.
