تهدف هذه الدراسة إلى التعرف على واقع التجارة و الدفع الإلكتروني في الجزائر، حيث تناول الجانب النظري من هذه الورقة البحثية التغطية القانونية لكلا المتغيرين من وجهة نظر المشرع الجزائري (الواقع القانوني)، أما في الجانب التطبيقي فقد تطرق لواقع ممارسات التجارة و الدفع الإلكتروني في الجزائر بالاعتماد على استمارة استبيان.
بينت نتائج الدراسة عدم وضوح التشريعات الصادرة فيما يخص التجارة الإلكترونية و نظم الدفع الإلكتروني، أما التحليل الإحصائي لنتائج الاستبانة فبين زيادة محتشمة في إقبال الجزائريين نحو عمليات الشراء و الدفع الإلكتروني، كما لمسنا فقدان ثقة جوهري عند اختبار مدى ثقة المتعامل الجزائري في التعاملات الإلكترونية في مجال دفع و استلام الأموال.
الأمر الذي يوجب رفع الثقة من خلال التقنين الواضح و الصرامة في التعامل مع جميع المتعاملين الاقتصاديين.
Abstract EN
This study aims to identify the reality of commerce and electronic payment in Algeria, where the theoretical side of this research paper dealt with the legal coverage of both variables from the point of view of the Algerian legislator (legal reality), while on the practical side, it touched on the reality of trade and electronic payment practices in Algeria by relying on questionnaire form.
the results of the study showed the lack of clarity of the legislation issued with regard to electronic commerce and electronic payment systems.
as for the statistical analysis of the results of the questionnaire, it showed a modest increase in the turnout of Algerians towards electronic purchase and payment operations money.
this requires raising confidence through clear regulation and strictness in dealing with all economic operators.

Cette étude vise à identifier la réalité du commerce et du paiement électronique en Algérie, où le côté théorique de ce mémoire de recherche a traité de la couverture juridique des deux variables du point de vue du législateur algérien (réalité juridique), tandis que du côté pratique, il a abordé la réalité des pratiques commerciales et de paiement électronique en Algérie en s'appuyant sur le formulaire questionnaire.
les résultats de l'étude ont montré le manque de clarté de la législation édictée en matière de commerce électronique et de systèmes de paiement électronique.
quant à l'analyse statistique des résultats du questionnaire, elle a montré une augmentation modeste de la fréquentation des algériens vers les opérations d'achat et de paiement électronique de l'argent.
cela nécessite de renforcer la confiance grâce à une réglementation claire et à la rigueur dans les relations avec tous les opérateurs économiques.
