Abstract EN

The subject of customary marriage is one of the most serious contemporary issues.

Although the legislator has required that the marriage contract be registered in writing, some individuals are omitting this requirement and marry without it.

In practice and in law ,customary marriage raises many problems , specially when the husband denies the marital bond, where there is dispute between the parties as to its existence or validity, and one of the spouses –often the wife- is unable to prouve this customary marriage , resulting in many problems not only affecting the parties to the marriage contract , but also extending to children and society.
