يهدف المقال لدراسة نوع مستجد من الحروب وهو الحرب بالقانون؛ والتي يقصد بها تلك الحروب التي تستخدم فيها الدول القانون كسلاح للإطاحة بالعدو ولتحقيق الأهداف العسكرية.
يدرس المقال حالة النزاع الروسي الأكراني الذي طبقت فيه لأول مرة الحكومة الأكرانية علنا الحرب بالقانون من خلال آليات قانونية وأخرى قضائية، وذلك بسبب عدم قدرتها على مجاراة الاتحاد الروسي عسكريا.
Abstract EN
The article purports to discuss a new type of war, which is warfare.
it is a war in which law is used as a weapon to overthrow the enemy and achieve military goals.
where this article deals with the case of the Russian-Ukrainian conflict, in which the Ukrainian government for the first time openly applied war by law through legal and judicial mechanisms, due to its inability to keep up with the Russian federation militarily.
