Abstract EN

Contact is one of the reasons of attaining proprietorship in the Jordanian legislation.

It results from the integration of two owned things by two different persons, regardless whether or not such integration was through the will of the human or by act of nature.

It may arise between two real estates; movable property and real estate; or even between two movable properties.

This study aims to shed the light on the contact of the movable property with a real estate by the human act which is termed as «artificial Contact», in order to find out answers to many questions such as: do the contact rules seek to organize the contact effects?, and hence, focused on the settlement of the emerging relationships between the landlord and other parties ?do such rules actually solve the problem of the of determining the property? In other words, can we consider the contact rules as a general theory applicable to the similar cases in the case of the silence of the legislator or the parties with regard to the fate of the constructions? Moreover, this study examines whether the Jordanian legislator had considered the contact as a simple proof of property right according to Article (1137) of the Jordan Civil Code, and if not so, can we add new Real rights? Which may lead to the segmentation of the property right?
