Abstract EN

The purpose of this study is to shed lights on principle of dual criminality as a necessary requirement for extradition and as a very essential guarantee because of its relation to state's sovereignty, human rights, and principle of criminal legitimacy either substantive or procedural.

Therefore, this study will explain the meaning of this principle, and the ways it is prescribed either in national laws or in international treaties.

Also, the study will discuss its justifications, exceptions, if there is any, and difficulties the application of this principle may eaise.

Finally, this study will search the stand of Kuwaiti law with regard to this principle whether in international treaties in which Kuwait is state party or in national laws.
