Abstract EN

Today, insurance is the most important elements underlying the global economy, and the strength of the insurance industry is the most important criteria for measuring economic strength.

Although the idea of the insurance contract is basically a western idea, it is acceptable in terms of Sharia.

So, we may take advantage of that idea in investment and development, if that conform to the principles of our religion, and if we deal with it according to our own system, away from the applications which conform to philosophy of capitalism.

However, we must develop it from the simple image to the investment idea which contributes to economic development.

This research dealt with the concept of cooperative insurance and its form,scholars' opinion of that type of insurance,jurisprudential adaptation for cooperative insurance companies and the contracts for that type of companies,the impact of that adaptation on provisions relating to these companies,the nature of the contractual relationship and then this research dealt with the importance of investing in the cooperative insurance and controls of that investment, risks which faces that type of investment then clarifying the provisions of certain matters relating to this subject such as determining the pay for the insurance companies in consideration of their management of the insurance process, and Zakat (alms giving) of these companies, and the rule of speculation of these companies in the funds of insurances, companies share, and the distribution of surplus insurance.
