Arabic Abstract

هدفت هذه الدراسة الى التعرف على الطبيعة القانونية والسياسية لمجلس الأمن وتوضيح الاختلاف بينهما.

كما سلطت الدراسة الضوء على أبرز مظاهر اختلاله، بالإضافة الى عرض أهم المشاريع التي قدمت لإصلاحه والمعوقات التي كانت تحول دون تحقيق ذلك، وذلك للتثبت من صحة فرضية مفادها (ثمة معوقات بنيوية واخرى إجرائية تحول دون إصلاح مجلس الأمن لإنجاز وظيفته في حفظ السلم والامن الدوليين).

وقد اعتمد الباحث، في هذه الدراسة، على عدة مناهج منها المنهج التاريخي، المنهج الوصفي التحليلي، منهج التحليل النظمي، المنهج القانوني.

وتوصل الباحث الى عدة نتائج ومقترحات أهمها: أن مجلس الأمن عبارة عن جهاز تغلب عليه الصفة السياسية أكثر من كونه جهازا يعمل على تطبيق القواعد القانونية التي خصه بها الميثاق، إذ تبين ان قرارات مجلس الأمن تحمل الصفة السياسية وفقا لأهداف الدول دائمة العضوية ومصالحها.

كما مثل الاختلاف في المواقف والرؤى للدول الأعضاء حول الإصلاح وغياب الإرادة السياسية للتغيير، أهم المعوقات التي تحول دون تحقيق أهداف الإصلاح.

وخرجت الدراسة بعدد من التوصيات أهمها: ضرورة إعادة النظر في الميثاق.

ضرورة إصلاح هيكل المجلس وفرض الرقابة على أسلوب عمله.

تقييد حق النقض (الفيتو).

ضرورة وجود إطار قانوني لفرض العقوبات وفقا للفصل السابع.

English Abstract

This study aimed to identify the legal and political nature of the Security Council and to clarify the differences between them.

The study also highlighted the most prominent aspects of its imbalance, in addition to presenting the most important projects provided to reform the Council and the impediments preventing that.

Finally, the study wanted to verify the hypothesis stating that (there are structural and other procedural obstacles preventing the reformation of the UN so it could achieve its function in maintaining the international peace and security).

In this study, the researcher undertook several approaches including the historical approach, the analytical descriptive approach, the methodological analysis approach and the legal approach.

The researcher concluded to a number of outcomes and suggestions, some of the most important are: the UN is a more political system than a system which works on implementing the legal rules set out in the Charter, as it became clear that the Security Council decisions carry out a political nature coinciding with the objectives and interests of the permanent members.

The differences in attitudes and visions of the member countries on the reformation and the lack of political will to change presents the main obstacles to achieve the reformation goals.

The study came out with several results, most important of which are: the importance of reconsidering the Charter, the need to reform the structure of the Council and to monitor the style it works in, reselecting the right to veto, the need for a legal framework for the implementation of sanctions under Chapter VII.
