This article aims to examine the right to public service in the Algerian legal system.

If the public service is an administrative matter regulated by decrees and decisions, the right to public service is a constitutional right to be regulated by the Constitution itself, or at least by the complementary laws of the Constitution.

This article also aims to evaluate the Decree No.

88-131 regulating relations between the administration and the citizen, which is the only text in the Algerian legal system which explicitly organizes the right to public service.
