Abstract EN

The research discussed the legal problems in the relationship between the executive and the judiciary powers in the Palestinian constitutional system based on the separation of powers theory, within the period from 1996 until mid-2007.

The research discussed, by describing and analyzing all the legal items in the Palestinian Basic Law and the regular laws related to organizing the work between the two powers and the relationship between them.

The researcher depended on to the concept of separation of powers based on the modern vision.

The research concluded that, although the Palestinian political system has adopted the theory of separation of powers clearly in its basic law, organizing the relationship between the two powers based on the law has many legal problems that do not fit with the concept and the essence of the theory.
