Abstract EN

This study dealt with the case of proceedings before the International Criminal Court by the UN Security Council on the basis of the judgments of paragraph (b) from article 13, of Primary law.

Due to this article, the Security Council can refer a case to the Court by virtue of a decision issued under the 7th Chapter of the Charter of the United Nations.

The Security Council has used its authority to refer to the International Criminal Court in two cases, in the Sudan conflict, the events in Libya, and couldn't refer the situation in the case of Palestine and Syria to the International Criminal Court.
