Arabic Abstract

هدفت الدراسة إلى التعريف بنظام اللامركزية الإدارية و أركانها و مزاياها، و بيان مستوى تأثير اللامركزية على وحدة الدولة و قوتها و قدرتها على ممارسة دورها.

و بيان تأثير اللامركزية على ممارسة الدولة لوظائفها و شكل العلاقة بين الأقاليم و الإدارة المركزية في الدولة، و عرض لنماذج تطبيق اللامركزية الإدارية في دول العالم، و اعتمدت الدراسة على المنهج الوصفي التحليلي و حتى تقترب هذه الدراسة في صياغتها من النظريات العامة و التطبيقات العملية اعتمدت على الجمع بين طريقتين للبحث وهما الدراسة التحليلية.

و من أهم النتائج التي توصلت اليها الدراسة إن إنتهاج الدولة ذات النظام الفدرالي منهج الديمقراطية في الحياة السياسية سيترتب عليه الحفاظ على وحدة الدولة و تماسكها، أما منع الحكومة المركزية في العاصمة من التدخل في عمل الولايات الأعضاء عن طريق حصر الاختصاصات في يدها دون السماح لهم بمزاولة أي اختصاص يدخل في صلب ولاياتهم، أو مصادرة الحقوق و الحريات و عدم تقبل الرأي و الرأي الآخر، أو إنتهاج سياسة الحزب الواحد دون السماح بوجود أحزاب للمعارضة، أو أن تكون الأحزاب صورية، أو اشتراط الدولة أن يكون المرشح للبرلمان من الحزبيين أو ضرورة موافقة الحزب على ترشيحه؛ فإن الاضطرابات و الفتن و التفكك و الاستقلال و الانقسام هو مصير هذه الدولة.

و في ضوء نتائج الدراسة فأنها توصي : الاحترام الكامل للدستور العراقي النافذ و تطبيق نصوصه بأمانة وجعله المرجع الأخير و أن لا يتوقف العمل من اجل تعزيز سلطات المحافظات غير المرتبطة بإقليم لخلق الظروف المناسبة لتحولها إلى أقاليم متعددة، فوجود عدة أقاليم في الدولة العراقية ستزيد من ديمقراطيتها و من عقلانية و واقعية قادتها و المسئولين فيها.

English Abstract

The study aimed at defining the administrative decentralization system, its elements and its advantages, and the level of the effect of decentralization on the unity, strength and ability of the state to exercise its role.

And the presentation of the models of administrative decentralization in the countries of the world.

The study relied on the analytical descriptive approach.

This study is close to the formulation of general theories and practical applications based on the combination of two methods of research namely study Analytical analysis.

One of the most important findings of the study is that the introduction of a democratic system in the political system will result in the preservation of the unity and cohesion of the state.

The central government in the capital is prevented from interfering in the work of the member states by restricting the powers of the state without allowing them to exercise any jurisdiction Or the adoption of a one-party policy without allowing the existence of opposition parties, or the parties being sham, or requiring the state to be a candidate for the parliament from the parties or the need for the approval of the party to nominate him; The disintegration, disintegration, independence, and division are the fate of this country.

Excluded from these political considerations in the international arena, and the interference of foreign hands in supporting some states for their independence, this is a fundamental reason for the disintegration of these countries.

In light of the results of the study, it recommends: full respect for the Iraqi constitution in force and the application of its texts faithfully and make it the last reference and that does not stop work to strengthen the powers of the provinces not associated with the province to create the conditions for the transition to multiple regions, the presence of several regions in the Iraqi state will increase its democracy and the rationality and realistic Its leaders and officials.
