Abstract EN

Transplantation of human organs from dead , to the living, is considered as a window , of hope, for many patients , in return , it brings a great fear with it .

For Islamic law scientists ,they split into two ways , some considers absolute forbiddance, and some others consider permissibility ,with predefined boundaries, all regarding the position of Islamic Fiqh ,as for Algerian legislator, it approached the law n° 85-05 ,on the protection and promotion of health, establishing legal terms to carry , out this operations.
