Abstract EN

Partnership contracts between public and private sectors are deemed among the modern mechanisms of financing projects such as roads, hospitals, electricity networks, communication and sewerage.

The emergence of this tool was partly attributed to shortage of government financial resources and to the willingness of countries to utilize economic, administrative and technological potentials available at private sector.

The aim of this study is to identify the nature of partnership contracts between public and private sectors; their usefulness in financing infrastructure projects and in improving related services in addition to the effectiveness of the legal regulation of such contracts.

Law No.

(22) of 2015 on the Regulation of PPP (Public-Private Partnerships) has been issued to promote the contribution of private sector to infrastructure projects.

Dubai Emirate has endorsed this legislation as a legal framework regulating transparently and accurately the rights and obligations of partnership parties.

Study throws spotlight – through an analytical, comparative presentation - on the major features and shortcomings of the aforementioned law in a bid to present recommendations for their remedy.

Study consists of two parts, the first one tackles the nature of partnership contracts between public and private sectors, while the second turns spotlight on the legal regulation of partnerships contracts in Dubai in comparison with some similar legislations in Arab Countries
