Abstract EN

This study addresses the adequacy of Jordanian legislation on juvenile rights during trial stages as stipulated in the Juveniles Act No.

32 of 2014 and its compliance with modern criminal policy that aims at rehabilitating juveniles socially, psychologically, professionally and in practical life based on the personality of the juveniles, his social conditions and the reasons that led to his delinquency.The methodology used in the study is based on comparing the provisions of this law with international juvenile standards and best practices.

Results show that the Jordanian legislator has complied with the majority of these principles, but the researcher proposes a number of amendments and additions to this law to enhance the responsibility of juvenile preventive and corrective judiciary.

These amendments are as follows: follow-up, finalization and consolidation of specialized judiciary by stipulating in the law that juvenile first instance courts in all of the Kingdom's governorates should be created; the creation of independent appeal commissions, within the appeal courts in the Kingdom to decide about juvenile lawsuits; the formation of juvenile courts by using the mixed system, i.e., in addition to specialized judges, experts in sociology and psychology should participate and attend trial procedures.

The law should also clearly stipulate that juveniles have the right to participate in trial proceedings and have the right to be given a hearing as general principles of the juvenile justice in Jordan.
