Abstract EN

This study investigates one of the Islamic inheritance basic rules; wherein with the presence of an immediate surviving offspring, an ancestorial relative cannot inherit in the presence of this intervening relative.

The researcher explained the concept of this rule on singularly and collectively; also focused on showing the foundation of this rule from both Quran, Sunnah and reason as well as showing exceptional cases, opposites and its contrarious argument.

In addition, the researcher clarified its and its relevance to inheritance rulings; its branches; its applications; the branching of the exceptions and the opposite cases; as well as the concept of the derived contrarious arguments
