Abstract EN

It is almost certain that all governmental actions involve legal aspects related to public policy issues, where no public policy is drafted apart from procedural, administrative and legal criteria.

These are often -wholy or partialy- laid down in an orderly fashion.

As for the Shari'a disciplines (ḍawābiṭ), they are often limited to prima facie aspect of jurisprudence, i.e.

the general legitimate rulings regarding the subject matter of public policy, while the criteria of Islamic legitimate politics )al-Siyasa al-Shar'iyya( related to public interest or the balances thereof are almost kept unimplemented.

When drafting policies, there is almost no connection between public policy and Islamic legitimate politics.

Therefore, we shall briefly explain and define the nature of public policy from the perspective of Islamic legitimate politics, and discuss the legal, administrative and procedural criteria, in addition to clarifying the causes behind policy contradictions.
