The constitution recognizes that an objection of unconstitutionality may be referred to the Constitutional Council on referral from the Supreme Court or the Council of State where one of the parties to the proceedings argues before a court that the legislative provision on which the outcome of the dispute depends violates the rights and freedoms guaranteed by the Constitution

La constitution reconnait aux justiciables le droit de soutenir que la disposition législative dont dépend l'issue du litige porte atteinte aux droits et libertés garantis par la Constitution, le Conseil constitutionnel peut être saisi de cette exception d'inconstitutionnalité sur renvoi de la Cour suprême ou du Conseil d'Etat.
