Arabic Abstract

تناولت هذه الرسالة موضوعا يعتبر من أهم الموضوعات التي يواجها العصر التكنولوجي الحديث، و هو أثر التعبير عن الرأي عبر الوسائل الالكترونية على الحق في حرمة الحياة الخاصة، حيث أنه في موضوع الحق في حرمة الحياة الخاصة و بفعل التطور الحديث من أساليب و وسائل حديثة في مجال المعلوماتية و الاتصالات السمعية و البصرية، كان هناك تداخل في مفردات الموضوع و تشابكها مع حرية التعبير عن الرأي عبر الوسائل الالكترونية.

فكان لا بد من التعرف على القيود الواردة على حرية الرأي و التعبير والحق في حرمة الحياة الخاصة ومدى التوازن فيما بينهما، و بيان القيود القانونية و الرقابة المفروضة عليها، و ذلك من أجل رسم الصورة الواضحة لحرمة الحياة الخاصة و ارتباطها بحرية التعبير عن الرأي.

و قد قسمت هذه الرسالة إلى فصلين، تناولت في الأول موضوع التعبير عن الرأي عبر الوسائل الالكترونية، و في الفصل الثاني تناولت الموازنة بين حرية التعبير عن الرأي عبر الوسائل الالكترونية و الحق في حرمة الحياة الخاصة، و قد توصل الباحث إلى جملة من النتائج جوهرها " حرص التشريع الأردني على إيراد عدة قيود على حرية التعبير عن الرأي عبر الوسائل الالكترونية و قد بينها المشرع الأردني بالتفصيل، و من أبرز تلك القيود و أهمها قيد احترام الحق في حرمة الحياة الخاصة "، أما التوصيات فأهمها " أن ينص المشرع الدستوري الأردني على أن تكون القيود التي تفرض على ممارسة حرية التعبير ضرورية لتحقيق أهداف محددة، و أن يكون من ضمنها حماية حقوق الآخرين و حرياتهم و بالذات الحق في حرمة الحياة الخاصة".

English Abstract

This subject is considered one of the most important topics facing the modern technocratic era.

It is the effect of the freedom of expression through electronic means on the right to inviolability of private life.

As for the right to privacy and the modern development of modern methods and means in the field of information and communications Audio and video, there was overlap in the vocabulary of the subject and intertwined with the freedom of expression through electronic means.

It was necessary to identify the restrictions on freedom of opinion and expression, the right to privacy and the balance between them, and the legal restrictions imposed on them, in order to paint the clear picture of the sanctity of private life and its association with freedom of expression.

The second chapter dealt with the issue of expression of opinion through electronic means.

In the second chapter, the balance between the freedom of expression through electronic means and the right to inviolability of private life was discussed.

The researcher reached a number of conclusions: The most important of which is the restriction of freedom of expression through electronic means, including the Jordanian legislator in detail, the most important of which is the restriction of respect for the right to privacy.
