English Abstract

The Candidate in her thesis deals with the impact of the Diplomatic Immunity of the individuals' basic rights, due to its importance scientifically and practically.

The First Chapter addresses the nature of Diplomatic Immunity, its range, type and legal ground, whereas, the candidate in the Second Chapter deals with the impact of this Immunity on the rights of the individuals in peace and conflicts.

As the candidate refers to how to utilize Immunity as a means to escape punishment via the judicial immunity granted to the designated diplomat who is exempted from being subjected to internal legislation of the state assigned to the designated diplomat, it has been clarified that this immunity cannot be used before international criminal courts for crimes committed during conflicts, however, there are many practical and lawful challenges to hold specialized criminal courts.

The Candidate concludes her thesis with the necessity of laying down new provisions for the agreements held concerning the lmmunity that the diplomats enjoy, that is through considering the violations that designated diplomat carries out in confronting individuals of the hosting state and the most important their right to live, and the subject of the impact of the Diplomatic lmmunity in the international law should be solved far from political and economic crisis and the ideological differences existing worldwide.
