The internationalization of trade induced by economic globalization has led to the growth of international business development.
This was accompanied by the emergence of a significant conflictuality about the applicable law in disputes related to international trade.
While the provisions of private international law tend to establish the rules of conflict of laws that could theoretically determine the law applicable to disputes without specifying materially the rhetorics in their settlement, the law of trade, however, includes a set of conventions and international treaties in order to establish substantial rules that take over the state rules and give globally direct solutions to international commercial disputes.
These international conventions agree with the methods adopted by the States in order to eliminate conflicts in the international trade laws, or at least reduce the incidence, knowing however that the unification of the rules in conflicting laws is not easy, given their lack of completeness and divergence in legal doctrines in this area.

L’internationalisation des échanges induite par la mondialisation économique a conduit l’essor du développement du commerce international.
Cette situation s’est accompagnée de l’émergence d’une conflictualité importante au sujet de la loi applicable sur les différends liés aux relations du commerce international.
Alors que les dispositions du droit international privé tendent à instaurer les règles des conflits de lois susceptibles de déterminer théoriquement le droit applicable aux litiges, sans préciser matériellement les rhétoriques de leur dénouement, le droit du commerce international, en revanche, englobe un ensemble de conventions et de traités internationaux conclus dans le but d’asseoir des règles substantielles qui prennent le relais des règles étatiques et qui donnent de façon globale des solutions directes aux litiges du commerce international.
Ces conventions internationales rejoignent les méthodes adoptées par les Etats dans le but d’éliminer les conflits de lois en matière du commerce international, ou du moins, en réduire l’incidence, étant précisé cependant que l’unification des règles des conflits de lois n’est pas chose aisée, compte tenu de leur manque d’intégralité et de la divergence des doctrines juridiques dans ce domaine.
