Depuis la consécration du principe de légalité de traitement entre l’investisseur national et étranger, le régime des investissements en algérie a connu une évolution remarquable.
Toutefois, après l’édiction de la loi de finances complémentaire pour l’année 2009, l’investisseur étranger s’est trouvé devant un régime discriminatoire qui lui impose d’accepter des conditions discriminatoires et compliquées.
Parmi celles-ci, on cite à titre d’exemple, la déclaration de l’investissement auprès de l’agence, l’investissement étranger est soumis a l’examen préalable du conseil national de l’investissement, son projet doit se faire dans le cadre d’un partenariat dans lequel la part de l'investisseur national résident représente 51% au moins du capital social...
