Sudan did not enjoy the independence over the historical stages that accompanied the development of the crisis of south sudan, as quickly fed the seed of colonialism which aired in which to develop the spirit of separation among people of the South and the war broke out, while the Sudanese government has failed to Settlement the crisis over the successive governments policies.

the internationalization of the South crisis intervened major foreign powers, and under pressure the Sudanese government made concessions resulted in the conclusion of the Nifasha Agreement in 2005, which serves as the official announcement of the establishment of the State of South Sudan independent institutions was reflected later in the temporary Interim Sudanese Constitution for the year 2005; they acknowledged the right of self -determination for southern Sudan through a referendum either for unity or secession, which actually decides in the year of 2011 .

this convention was the legal framework for the secession of South Sudan, because that the separation issue realistically have no basis in international law only some jurisprudential theories.
