Abstract EN

Through our extrapolation of the Algerian penal code, we find that it has faced the problem of the kidnapping of children by several criminalizations.

When we observe we notice that in spite of the multitude of these criminalizations, they aim at protecting two primordial laws that guarantee to child good care and education.

The first is the right to keep his real personal status based on the pedigree.

Moreover, the second is his right to care and education under the authority of a trustee.

As part of the dispositions of trusteeship, all kinds of abduction, whether positive or negative can be qualified as a violation of one of these two rights, then they form the two prominent points of all child-kidnapping crimes.
