Abstract EN
Presumably, contractual relationships are based on the principle of contractual balance.
i.e, it is supposed to be a kind of equality between the sides of the contract in terms of rights, obligations and liability of these members, or in terms of the contract's content and conditions itself.
The contractual relationship between artisans and consumers has been unequal due to the experiences and professionalism, economic power, skills and knowledge that the former has whereas the consumer lacks .
Advantages as such weakens the consumer.
The skilled and economically powerful profession may impose certain conditions on the less powerful and skill-lacking consumer .Consequently ,there is a strong desire to find ways to protect consumers against the arbitrary and abusive conditions in consumption contracts.
