Abstract EN

This paper provides a comparative study of the role and jurisdiction of public prosecution in determining criminal cases without trial.

Although such decree is well established in various criminal procedural laws, there is no reference or regulation for such method in the Jordanian Criminal Procedural Law (JCPL) or the criminal procedural law of UAE.

This paper argues that if such notion is adopted by both laws, it shall contribute to settling criminal disputes and cases in a speedy fashion saving the efforts and resources of criminal courts.

The paper also contends that the JCPL and the UAE law, if to adopt such notion, might well benefit and borrow from the rules relating to criminal decree as established in other comparative criminal procedural laws.

The paper, therefore, sought to provide a comparative study of this contentious issue in an attempt to provide insight into how any legal reform on this issue in both laws can be informed by the rules as established by other comparative laws.
