Abstract EN

This paper examines and analyzes the boundaries between the legitimate use of the right to litigation and the abuse of this right in the Algerian civil and administrative code 08/09 of 25 February 2008.

Whether the right to litigation is an expression of a fundamental freedom of the individual guaranteed by international treaties and conventions and most national constitutions and legislation, or considered to be one of the basic rights of the citizen, this may lead to abuse of the user, causing damage to the adversary or prolonging the dispute under arbitrary and malicious proceedings.
