Abstract EN

This study aims to describe and gauge the media control path .So in this paper ,we discussed the media discipline in the Algerian context by analyzing and comparing media codes of the years 1990 and.2012 This treatment was done through the systematic reading of both codes in order to determine the added value of both legislations .As well as to identify the similarities and differences between them .Where it was noted that the code of 1990 is a major leap for the media control in Algeria ,which has seen a legal vacuum in this area since independence .So this code considers like the first law that authorizing the establishment of private media institutions with ease and freedom .As stated by the Supreme Council of Media ,which had enormous powers and stands on the entire media sector in the country ,which was canceled and replaced by the powers of control of each branch of the media as stated in the 2012 code ,but this does not mean that the latter one did not give a positive things ,On the contrary ,it abolished prison sentences for press offenses and provided additional protections and rights to the journalist ,such as recognizing his intellectual property and defending him in the field of his work from the arbitrariness of his employer or his exposure to potential threats posed by this field.

Nevertheless ,we sought some sort of ambiguity to control the advertising sector and the slowdown in the installation and formation of various bodies and authorities by the state .How easy it is to imagine and legislate those codes to fill the gaps in the legal field ,then offset by ambiguity in how to apply and violation of follow-ups and control practices
