Abstract EN

This study addresses an important issue, which is the conflict of competence in civil litigation in Emirati by identifying the kinds, types or cases of the problem and the solutions adopted for it through an analytical study.

The study shows both the Emirati law’s position and the Emirati courts’ application in this field, along with assessing the adopted regulation in this regard.

The study is divided into two parts: the first part defines the Emirati judicial system insofar as it is concerned with the issue of the conflict of competence, in addition to defining the problem and the aspects of its occurrence.

The second part, however, addresses the envisaged solutions that are adopted by the Emirati legislator to settle the problem in question.

Assessment and analyses of the adopted regulations are also addressed in this part.

The study ends by espousing more than one recommendation that aims at raising the level of the regulations put by the Emirati legislator to a higher level, with a view to reaching the maximum justice such rules sought to achieve.
