In practice, it is necessary to divide the common money between partners.

The co ownership is an unstable state of concern for the large number of problems and disputes that negatively affect the management and use of money.

The divided property is always better exploited than common property because it allows to partners to expoliate their ownership separately.

Therefore, we discussed the division as a contract aimed at ending the common property, through analyzing the legislative and judicial texts of the division of the agreement and the division of the judiciary, we presented the procedures of how to divide the division of agreement and division of judiciary and adopt solutions to each partner to obtain the full right of ownership, The study highlighted the most important legal effects of division, and we concluded that the division does not creat any new right, it is only a transfer of ownership The researcher also talked about the basis of compensation and its elements where there are two principles to the compensation, the first known as full compensation, and the other known as an equitable compensation, then the researcher concluded the study with a set of findings and recommendations.
