Abstract EN

This paper aims to focusing on an old and new issue which is as perpetual as man's everlasting craving for survival and life, this issue is the human financial rights, in his constant endeavor, however, man accumulates all the financial rights under his control, after his death his relatives acquire the right to seize all his money and property via ancestry, all the divine doctrines and legislated laws have emphasized this very particular right, yet, the diversity and variety of rights in nature and adaptation all led to a clear disagreement among theologians concerning the ability of those rights to transfer from the dead person to his heir, as a result there was a clear clashing juristic explanations, While some rights are purely financial, others are not and are primarily related to the person himself and his human wills, Some rights, moreover are financial and also contains personal elements and vice versa, Such diversity requires precision in determining the fields of rights and the placing of each right in the field it deserves.

The present study, therefore, imposes its juristic and legislative necessity, it's also descends to the field of scientific studies in order to design the splitting line between this rights and that, it also design the meanings, descriptions, and features which necessitates the transference or the absence of transference, and to explain the structure of disagreement about the issue disagreed about and to decide the most correct and acceptable opinion as well.
