The Industrial bloom has tended to an increase in pollution and its harm on Man and his environment.

Hence, the protection of this latter and the necessity to maintain it has become an important topic of discussion throughout different media.

Also, discussing the dangers resulted from pollution, is also an important part within the international conventions and local regulations.

This is because; the protection of the human environment free from pollution is one of the essential tasks of the modern state.

The main solution to such problem is the protection from the ecological damages.

No one can ignore that to compensate these damages is another main pillar of the situation.

Since, it is a result of the failure of the preventive ways in solving the ecological damages.

Different kinds and legal means have been proposed to make amends for the payment of these damages, such as the compensations according to the general rules, the classical insurance system, the recompensation funds, and the substitute systems to cover the ecological pollution.

And because of the increase of the compensation volume which surpass the means of the insurance companies; many countries have joined these latters to overcome this failure in paying those damages.

Moreover, those countries are trying with the modern regulation power, to fill the needs and the lack of paying for damages related to the environment by founding recompensations funds, supporting them through the application of subtitutemecanisms aiming to reach a full fair recompensation for the victim part of the case.
