English Abstract

In addition to their roles through assistance, opinion, participation and consultation with the public authorities in this field, the contribution of associations to the protection of the environment varies: It has another mechanism to embody this protection through the right of recourse to the judiciary in the cases of prejudice and the damage to the surrounding environment in its various components and elements.

The contribution of the associations in providing environmental protection to the administrative judiciary is reflected mainly in the dissolution of the decisions issued by the administrative authorities in the State at various levels, like any person or individual who has been harmed in this area.

The establishment of associations in cases of infringement and damage to the environment is reflected through the filing of administrative action in this context when the availability of general and special conditions Then the administrative judge intervenes in the area of cancellation and ensures the integrity and validity of the administrative decision which is the subject of the lawsuit through its external elements Especially when there is a defect in the lack of jurisdiction and defect of form and procedures and its internal components not to violate the law or deviation of the administration in the use of power.

He shall cancel it if one of these defects is available in its premises and elements or in the area of compensation or complete elimination under the responsibility of the public administration on the basis of error or without error when the conditions and rules are available, especially the written authorization requirement of at least two natural persons in respect of exposure to damages classified as individual, the Assembly shall, in their name, sue for damages in respect of any judicial body.
