Abstract EN

The study deals with an important issue related to the rights of those injured by motor vehicles accidents, which is the compulsory insurance.

While the number of vehicles is increasing as needed in all societies, there is a direct increase in the number of accidents caused by these vehicles and the number of its victimsق This has made countries think of a way to minimize the effects of these accidents by ensuring that victims are quickly and easily compensated for their urgent need to treatment or compensation for their sentimental damage.

The way used in most countries is the compulsory insurance of motor vehicles accidents, but Iraqi law has taken its own methodology in regulating this issue, which caused many contradictions and leaps in the provisions.

While the name of the Act is "insurance", we find that relationship between the insurance company and the owner of the vehicles is legal, it is not contractual; this is not consistent with the insurance contract.

This study comes to deal with the issue in Iraqi law compared to the Egyptian and Jordanian laws, and presents an appropriate perception with the proposal of provisions should be adopted instead of existing vague ones.
