Starting from the principle of strengthening the rule of law and tackling the problem of corruption and looting of public money, Algeria has embraced a new policy in line with the evolution of the fight against corruption .

In 2004, it ratified the United Nations Convention against Corruption under Presidential Decree No.

04/128, thereby putting the national legislative system in accordance with the principles of the Convention and even constitutional zing the fight against corruption establishing a national body for the prevention of corruption (Article 202 of the Constitution).

Public procurement is the most vulnerable to corruption in all its forms, considered as the most widespread public funding in Algeria.

Hence, they must be safeguarded against all forms of corruption and bad governance, as well as the implementation of legal mechanisms to fight against corruption and take the necessary measures to consolidate transparency and integrity.

This only reflects the principles of governance and good governance.

In this respect, what mechanisms of governance and good governance have been adopted by the Algerian legislator to fight against corruption in public procurement? Have they already achieved their goals?

Partant du principe du renforcement de l’Etat de droit et de s'attaquer au problème de la corruption et du pillage de l'argent public, l'Algérie a embrassé une nouvelle politique en phase avec l'évolution de la lutte contre la corruption.

En 2004, elle a ratifié la Convention des Nations Unies contre la corruption en vertu du décret présidentiel n° 04/128 en mettant, par conséquent, le système législatif national conformément aux principes de la Convention et même elle a constitutionalisé la lutte contre la corruption en instaurant un organe national de prévention de la corruption (article 202 de la Constitution).

Les marchés publics sont les plus vulnérables à la corruption sous toutes ses formes, considérées comme le moyen de financement public le plus répandu en Algérie.

D’où, ils doivent être sauvegardés de toutes les formes de la corruption et de la mauvaise gouvernance, ainsi que de la mise en oeuvre de mécanismes juridiques de lutte contre la corruption et prendre les mesures indispensables pour consolider la transparence et l'intégrité.

Cela ne fait que refléter les principes de gouvernance et de bonne gouvernance.

À cet égard, quels mécanismes de gouvernance et de bonne gouvernance ont été adoptés par le législateur algérien pour lutter contre la corruption dans les marchés publics? Ontils déjà atteint leurs objectifs?
