تواجه العدالة الجنائية صعوبة كبيرة في إثبات الجرائم الواقعة على الأطفال، و ذلك لحدوثها في خفاء تام.
بالإضافة إلى أن الطفل الذي يقع ضحية اعتداءات لا يتبوأ بما حصل له إلا بعد مرور عدة سنوات تكون قد تلاشت كل الآثار المادية.
لهذا لقد استحدث المشرع الجزائري وسيلة أخرى للإثبات بموجب قانون "15- 12" المتعلق بحماية الطفل، يمكن للقاضي الاستعانة بها، تتمثل في سماع شهادة الطفل عن طريق التسجيل السمعي البصري.
Abstract EN
Criminal justice is often confronted with great difficulties when they are the infringements against the children because those are generally made in an absolute secrecy.
Moreover, the child victim does not declare what arrived to him only after several years during which all traces of physical after-effects will have disappeared.
Vis-avis all these difficulties, the Algerian Legislator adopted a new law “15-12” relating to the protection of the child according to whom, the judge can require with another means which consists in being based on the testimony of the child through an audio-visual recording.

La justice pénale est souvent confrontée à de grandes difficultés lorsqu’il s’agit des infractions contre les enfants car celles-ci sont généralement commises dans un secret absolu.
En plus, l'enfant victime ne déclare ce qui lui est arrivé qu’après plusieurs années au cours desquelles toutes traces de séquelles physiques auront disparu.
Face à toutes ces difficultés, le Législateur Algérien a adopté une nouvelle loi «15-12» relative à la protection de l’enfant, selon laquelle le juge peut requérir à un autre moyen qui consiste à se baser sur le témoignage de l'enfant à travers un enregistrement audio-visuel.
