Abstract EN

Although the UN Charter's explicit provisions have made two exceptions to the principle of the prohibition of the use of force, international practice has established other exceptions which has been devoted by either the broad interpretation of the provisions of the Charter or produced by the acts, resolutions, conferences of the United Nations or international conventions, including the use of force by peoples as a means of self-determination.

This was disputed about the extent of its legitimacy between a supporter who founded it with the right of self-determination and the right of legitimate defense, and an opponent who disclaimed it.

Despite the fact that the Universal Declaration of Human Rights lacks any reference to the right to selfdetermination; Articles 1/2 and 55 of the UN Charter have dedicated it.

Not to mention its adoption under article 1 of the International Covenants on Human Rights.

The General Assembly's affirmative resolutions on the right to self-determination have continued, with the right of peoples to armed struggle to be included.

Despite the continuous attempts of the opponents of this right to be included in the group of acts of terrorism and illegal acts, work and legal positions have made a settled decision to recognize the right of armed struggle for self-determination, therefore, it is time for it to be included in the provisions of the Charter of the United Nations in order to gain explicit legitimacy as the latter is considered to be a Global Constitution.
