Abstract EN

The complaint from the judges (Suing judges) is a judicial system designed to ensure the neutrality, independence and impartiality of judges, and to establish the principles of justice and fairness among litigants to promote confidence in the judiciary and its provisions.

It also aims to protect judges from the object of opponents and to immunize them against the temptations and pressures they may face it when they perform their judicial function.

The Iraqi legislature has allocated Title IV of Book III of the Civil Procedure in force to indicate the substantive and procedural provisions of the complaint from the judges and it's legal effects.

However, the personal scope of this complaint was limited by the Iraqi legislature who followed on the appellate courts, A wide range of other court judges are not subject to its provisions.

This study concluded that the relevant provision was not legitimate for violating a constitutional provision, and also for incompatibility with an enforceable legal text.The study recommended amending that text and proposed a new formulation for it.
