Abstract EN

This study deals with agreement and acceptance in the commerce contracts, according to the Algerian legislator, and the UNCITRAL Model Law and some comparative legislation, with the aim of clarifying the concept and nature of the agreement and of acceptance and determination of its conditions in this type of contract.

Where we learned through this document, exposure to a legal approach between commercial contracts via electronic media, the most important of which is the Internet with the general theory of the contract, the application of the digital system has been reflected in all the traditional contractual process, and affect the set of judgments and the absence of several problems due to the privacy of this type of contracts, the most important is that it is carried out by electronic means and is held without any material presence of contractors in a true contract in a council, which led to the creation of special provisions for electronic agreement and acceptance, which vary according to the type of electronic means used, the most important ones are e-mail, website, conversation service or live viewing.
