Abstract EN

This study aims to clarify the establishment of family in the Islamic Sharia to make the two spouses aware of marriage on these grounds.

If these grounds are taken into account in marital life and guided by both spouses, the family establishes a strong and sound basis and ensures its permanence, stability, happiness and reconciliation, love and harmony.

The study also argues that if these foundations are neglected and disrupted, the family system will certainly collapse, The researchers make use of extrapolation method, revealing the scholars’ opinions on this issue, and how family establishment is seen in Islamic law, The study concludes that the family in Islamic Sharia is based on solid foundations, which can be divided into three types, namely the foundations of the creation of family through the good choice and the engagement, the foundations of establishment and formation, and the foundations of continuity and permanence through fulfilling both spouses’ rights.
