Abstract EN

This research article aims to clarify the jurisdiction of deciding on appeals regarding the election of the members of Bahrain House of Representatives according to Bahraini electoral system.

Early in 2001 and after the emergence of Bahrain National Action Charter that served as a basis for shaping numerous political and democratic reforms and restoring parliamentary life to the kingdom of Bahrain.

Since this time, the Bahraini parliament has been elected and has functioned for four terms, which led to the emergence of a number of electoral appeals.

This research seeks to answer two main questions, first; which entity is competent to hear the electoral appeals? And is the jurisdiction of hearing electoral appeals confined to one judicial entity or two different entities, bearing in mind that the Bahraini legal system adopts unified judicial system? Second, what is the scope of jurisdiction in determining the electoral appeals of electing the members of the Bahraini House of Representatives? Does it encompass all election procedures or it is confined to a specific procedure according to the well-established criterions of broad and narrow electoral appeals?
