Abstract EN

This study tries to analyze the laws and regulations related to decentralization; especially the law of decentralization no 49 of 2015, aiming to evaluate the degree of decentralization, its defects then proposing some suggestions that will help to reinforce the advancement process towards decentralization in local administration.

The study concluded that decentralization is a necessary action, but the legal rules did not achieve the required degree of decentralization, because they gave important powers, such as plan development and budgeting to the Executive Council, which an appointed council.

Besides, they did not give mandates to the unit that incarnates decentralization, which is the elected provincial council.

The study also suggested giving the provincial council the right to initiate, develop plans and budgets, and reduce the number of members of the provincial council in order to activate its work, in addition to setting conditions for membership and giving an equal number of votes to voters in all governorates.
