Abstract EN

This study discusses the legal value of employees’ records in legislation and court rulings by outlining the regulations related to it in the French as well as in some Arabic legal systems, with particular emphasis on the laws and regulations referring to the civil service as well as the extent and legal value of these records in disciplinary proceedings and judicial decisions.

This research concluded that information in employees’ personnel files has a legal value as evidence in both disciplinary and judicial proceedings.

However, although the French and some Arab legislators have acceptably deals with this legal value in a partial way, other Arab legislators under consideration in this research have not addressed the legal value of this information adequately, and this caused a salient legislative deficiency.
